A $70,000 Settlement After a 5-Year HOA Battle Over a 12-Inch Cross. Was It Worth It?

A five-year dispute in The Villages, Florida, shows how quickly a small disagreement can turn into a long and expensive fight.

A couple placed a simple 12-inch white cross in their yard. Their community development district said it violated rules on lawn ornaments. What followed included $25-per-day fines, legal filings and a settlement that cost the district $243,000.

The case never reached a judicial ruling or jury verdict. It ended with a negotiated agreement between the couple and the district. The cross was allowed to remain only after being mounted on a flowerpot.

This settlement ultimately favored the homeowners, but the long dispute shows how easily matters like this can create financial fallout that could land on either side.

A simple disagreement turned into a multi-year legal conflict

Village Community Development District 8 notified Wayne and Bonnie Anderson in April 2019 that the cross in their yard violated appearance rules. When they refused to remove it, the district began issuing $25 daily fines.

The homeowners said many neighbors displayed similar crosses without issue. It is not known why this particular cross was targeted or why the initial anonymous complaint was filed.

The district eventually filed suit against the Andersons. The case moved slowly through filings and hearings, stretching across years and generating significant legal bills.

In the end, both sides agreed to settle. Settlements end disputes without declaring a winner or setting legal precedent.

The final agreement did not include an admission of wrongdoing. But the financial terms were substantial. The district agreed to pay the homeowners about $70,000. It also agreed to cover roughly $173,000 in legal and court costs.

The homeowners did not have to pay the accumulated fines.

A 12-inch cross should not have led to years of filings and a six-figure settlement, yet it did. Why this particular display drew a complaint when so many others did not remains unresolved.

What this case shows is how unpredictable housing costs can be, whether they come from enforcement actions or ordinary repairs. Knowing your community rules, keeping good records and staying financially prepared can help you avoid being blindsided.
